Terms of use for Mochilo and SillyMoney
This is an English translation for convenience; the German version (switch to DE) is authoritative.
1. Provider and scope
Mochilo (mochilo.io, called Reiselust in German, reiselust.io) and SillyMoney (sillymoney.io), each as a website and an app, are run by Christopher Blake Hümmer, Taborstr. 19, 10997 Berlin, Germany (contact: see legal notice). These terms apply to using both services. Both use the same account.
2. Services
Mochilo helps plan trips together, SillyMoney helps split shared expenses. Both services are in a beta phase and currently free. There is no entitlement to a particular availability or to particular features; features may change, be added or be removed. If paid features are offered in the future, separate terms apply to them, which you'll see before any purchase. Mochilo's referral program is additionally subject to the terms in its FAQ.
3. Account
- You must be at least 16 years old.
- The account is personal and not transferable. Use an email address that belongs to you.
- Keep your password secret and get in touch if you suspect misuse of your account.
- During the beta I approve new Mochilo accounts by hand; there is no entitlement to approval. You can use SillyMoney after confirming your email address, with an account created in Mochilo after agreeing on your first visit.
4. Rules of use
You may not use the services to
- store or spread illegal content or infringe others' rights,
- enter other people's data without their consent or a legitimate reason,
- harass or deceive others or assign them made-up debts,
- send spam or use the services automatically, in bulk or by circumventing technical safeguards (e.g. CAPTCHA or limits),
- impair the security or functioning of the services.
Only share invite links with people you want in the trip, the group or as a friend; anyone with the link can use it until you delete it.
5. Your content
Content you enter (e.g. trips, expenses, notes, files) remains yours. You allow me to store and process it and to show it to the people you share it with, as far as the services require. You are responsible for the accuracy of what you enter.
6. Balances and payments
Balances and settle-up suggestions are a calculation aid based on the data entered; I accept no liability for their accuracy. Payments between users (e.g. via PayPal or bank transfer) take place outside the services. I am not involved in them, process no payments and am not a party to claims between users. Exchange rates are indicative and may differ from the actual rate.
7. AI features, travel information and flight alerts
AI suggestions, information on entry, visas and vaccinations, flight alerts and hints about possible compensation are for information and may be incomplete, outdated or wrong. Check them before applying them and, if in doubt, with the responsible body (e.g. the German Federal Foreign Office or the airline). They are not legal advice.
8. Termination and suspension
You can close your account in your profile at any time; this applies to both services. You can end SillyMoney alone with "Leave SillyMoney". I may suspend accounts or restrict features if these terms are violated or misuse is likely; where possible, I'll let you know beforehand. I may discontinue a service with at least four weeks' notice; until then you can ask me for a copy of your data.
9. Liability
The services are free of charge. I am fully liable for intent and gross negligence, for injury to life, body or health and under the Product Liability Act. Otherwise liability is excluded as far as the law permits.
10. Reporting illegal content
You can report illegal content or misuse to christopher.huemmer@posteo.de. This address is also the single point of contact under the Digital Services Act for users and authorities, in German or English. I review reports promptly and let you know the outcome.
11. Changes
I may change these terms, for example for new features or changes in the law. I'll inform you of material changes at least four weeks in advance in the app or by email. If you don't object within that period, the changed terms apply; the notice will point this out. If you object, you can close your account.
12. Privacy
How I process personal data is described in the privacy policies of Mochilo and SillyMoney.
13. Final provisions
German law applies. If you are a consumer habitually resident in another EU country, the mandatory consumer protection rules of that country remain unaffected. If a provision is invalid, the others remain valid.
